Civil Liability Review
and
Update
This course is intended for all
agency personnel, but will be slanted toward supervisors.
Law enforcement
is an ever-changing discipline. Much of what we do is based on
constantly evolving case law. Both Federal and State courts
hand down decisions on a weekly basis, and many of those cases
directly impact on what police personnel do during their day-to-day
activities.
This course
will address recent case law as it pertains to law enforcement.
While generally non-state specific, this course can be customized to
individual state jurisdictions.
Specific areas
to be discussed include:

fundamental elements of risk
management;

principles of civil and
criminal liability;

the relationship of officer safety
to civil liability;
-
Federal civil rights law;
-
State law (where applicable);
-
cases pertaining to use of force
and control;
-
cases pertaining to the operation
of motor vehicles;
-
cases pertaining to the practice
of arrest and seizure;
-
cases pertaining to employment
practices;
-
best police practices and their
relationship to legal risk;
-
defensibility of departmental
practices and procedures;
-
what to do if you get sued;
-
anatomy of a liability claim;
-
interaction with insurance
carriers.
The format for
this class is essentially classroom lecture and discussion, with
small group exercises. Class participants should bring any
departmental documentation (policies, procedures, etc.) with them to
class.
